Has HTC removed what Apple is claiming as infringement? I would think they would remove this the minute the verdict came down. Some poster on TheVerge said they did. Wonder if that is true. If it is, I wonder why they were stopped....

They were stopped because, according to HTC, this is now standard procedure for any HTC shipment of phones coming in after mid-April 2012. That's why some One X's made it, because they came out before the mid-April start of this new rule for HTC when it comes to selling phones in the US.

Yep, they removed it long ago.

Truth is, Rezound buyers were worried about this hitting them around the turn of the year when the decision went down.

HTC had until April 19th to comply and according to accounts pushing this story, this is the first major shipment since that date.

As others have been entering the country before this, this could have been checked by Apple at any time, and no doubt was.

So this is just another Apple predatory practice.

The HTC stock drop and scare that hit their record growth last year in November was tied directly to this same case.

Apple is after all Android, but certainly the company that built the first one, HTC.

And yes, the horse named "this feature was done before Apple patented it" was beaten to death last year without success.

The patent system got broken terribly during dot com days legislation.

You live in a country where a recent patent was granted for making toast - "the bread freshening method." Look it up if you don't believe me.

Nothing here was invented by Apple. Nothing.

Would Sprint still sell the pre-orders knowing its possible this could take weeks to get resolved?

I would think Sprint would shut the whole process down and wait for a fix before releasing anything.

It would appear they did just that. I was told by a Sprint employee almost 5 days ago that they were hearing it would be delayed. They said they were hearing the rollout date might be changed to the 27th. The only thing that made me doubt her was when I realized the 27th is a Sunday but now it seems like Sprint knew this was going to be an issue at that time or before. If it was beginning to seep out to the customer service employees I have to believe it was known by those higher up prior to that point. Of course this is just mho. Hope I'm wrong.

Sprint HTC EVO 4G LTE – Full Launch Delay Inside Sprint Now

continuation of our earlier post – we can now (un)officially confirm that the FULL launch of the HTC EVO 4G LTE is now officially delayed. This is very preliminary, however, as of 11PM tonight, we can report:


  • FULL Launch DELAY
  • No pre-orders will be shipped
  • No HTC EVO 4G LTE devices will be sold in stores on 5/18
  • Internal conversations put the launch delay at least 10 days out, however that’s up to customs and a court right now

PLEASE NOTE: This can and likely will change over the next 12-24 hours, but as of right now, that is the status. We will know more after 10AM on Wednesday, and I’ll try to post an update as soon as I can after that.

How did T-Mobile's One S not get dinged on this? This whole thing smelling fishy to meh! :cool:

No telling what was on the shipment, we know about this because impacting a release is a move with high consequences, and because there was an inside leak from Sprint.

Could be other models affected as well.

they are all getting the same info from the same sources. the above Reuters blog reads almost word for word as the yahoo ad.

me personally i believe there will be a delay. this customs thing has been going on for at least a day or so. im still confident this will be wrapped up by this week. every blog wants to report on this just so they can get the exposure and clicks to their site.

lets let the dust settle overnight and re group tomorrow...

Apple is now the most profitable company in the world. I would be shocked if they are released by the end of the week. If they were stopped it was because Apple does not believe that HTC complied and is enforcing this. My bet is this has to get settled in a court. Which is going to take weeks. I really hope I'm wrong, but I have a feeling Sprint is trying to spin this more positively than it is. Dealing with customs is a grade A biotch and it always takes a long time to get things released. For instance this is a personal experience, a few months ago customs released a package that was supposed to be released over a year before it arrived to us. This is going to be a huge disaster.

At the time the LTEVO wasn't released so I was asking about the One X, but only as an inference of what would be included in teh LTEVO. So thanks for the info!

Edit: I just read the full article and don't see anything about an FM transmitter. It has FM radio for sure, but that's not what I was asking about.

My big question is, is this Apple telling the government to enforce this? Or is it just standard operating procedure due to the ruling? I feel like it has to be Apple or Sprint would have taken care of this already and "greased the wheels" (I am not hinting at bribery here) to make sure something like this didn't happen. I have a hard time believing the brokers for HTC and Sprint wouldn't know about this if it was just a normal customs thing. That being said if Apple is doing it, I'm not sure whether it's a brilliant move or stupid. It certainly galvanizes the fan boys of Android into hating Apple more...but on the other end for those upgrading to the LTE who are not huge on Android they could get talked into a iPhone4 when they come into upgrade. The other side of this coin is how does this affect relations with both Spring and for Apple AT&T. Let's face it AT&T and Apple have a symbiotic relationship and both rely on each other. Lots of interesting stuff with this one.

The way things are going the S3 might be out before this phone.

When they start throwing out "phone has been postponed indefinitely" that does not sound good at all.

I'm still waiting on the official statement from Sprint but if there is going to be a significant delay, I think they will have a hard time keeping people from cancelling their pre-orders...

This is why the policy of charging full price for pre-orders before the phone has even shipped is ridiculous.
