Ok, I think that the idea that Sprint did this knowingly is completely false.
Here's why -
I recall back on May 4, we were all looking forward to our pre-order on the 7th, and that we were all expecting a release with June, with some chatter about a rumored May release date.
Sprint could have taken just as many orders with the June expectation of delivery. They knew it. I expect that most here would have agreed with me back a few weeks ago, June 1 release would have been peachy.
And with the Sprint insider that leaked this (link for his blog coming below in reply to Sauske) saying that with the delay, they expect to release 10 days later, still within May, that all tracks.
So - maybe I'm wrong, but I'm going to place about 0.00000000% percent of the blame for this on Sprint, and about 0.000000000000000% on HTC.
This is Apple at work. They've known for some time that HTC is in compliance with the court ruling. They're simply flexing their legal muscles through a technicality.
And I think that anyone blaming the carrier, or getting upset over the incident (which, probably does something psychologically to the view of HTC - as in the dumb blog comments out there that poor Apple needs to protect their IP) - well, I think that's exactly what Apple wants you to do, think and feel.
