Help Several Problems w/Rhyme -- Should I Just Get it Replaced?

I have a new Rhyme (less than 30 days). I have several huge problems, the most distressing of which is that no matter how many times I set my phone to "Silent" in the "Sound Settings," it isn't silent. Not only isn't it silent, but it does this old-fashioned phone ring tone when I a) have not selected that option for my ringtone and b) have, in fact, downloaced and selected a purchased ringtone. That worked the day I bought it and never again. I don't dare take the thing into court knowing that it isn't silent and will go off whenever it wants. 2d problem, the screen will just go black. No particular application is associated with it, it just happens, I'm trying to run a Google search, or input my password for voicemail and everything just goes blank. The phone is on, and it will re-appear, but it can take 15 seconds to do so. 3d problem, the capacitator doesn't work consistently. I'm already sick of trying to run an internet search and/or read the results with the screen refusing to change depending on the orientation of the phone. Having scanned the Forum threads, these don't seem to be continuing problems and they don't seem to have occurred in a batch like this. Should I just get the phone replaced? Thanks 'cause I'm beyond irritated.
