Hi there.

I know for a fact that the members responsible for the fourteen posts I've deleted know our site rules well enough to know our mantras -

Attack issues, not each other.

Please be polite.

Rather than send out a bunch of private notices, I'll make it very, very simple - one of you just earned a well-deserved 7 day vacation from posting in our forums and the next outbreak of flaming is going to be dealt with severely.

This is a formal mod warning for all participants in the recent unpleasantness - I'm rather sure you're all reading this.

So - here's the thing:

Seems the OP is disillusioned with his favorite Android maker due to a claim made by Apple.

Definitely seems to me that that's no reason for name calling or questioning people's motives or integrity here.

This thread will remain in this forum temporarily to ensure that all have been led to water and then moved to the Lounge.

BTW, inflammatory title changed.

Groklaw - Samsung, Apple, FRAND -- What's It All About? -- Samsung's Side~pj Updated

Very good article covering the case and the trial briefs from both companies.

This is my favorite line from that article:

"That Samsung is able to offer such a wide variety of quality mobile telecommunications devices is no coincidence. Samsung has been researching and developing mobile telecommunications technology since at least as early as 1991 and invented much of the technology for today

Does anyone remember the LG Prada in 2006? Here's a side by side with the iPhone that came out a year later:

Rectangular, black touchscreen phone. Back then I couldn't tell the difference between the two - they all looked the same.

And this is the iPhone vs. the Galaxy S:

And here is the iPhone 4 vs. Galaxy S III:

So what can we conclude here. All smartphones from Samsung & Apple have taken after the Prada. And before the Prada a decade of evolving smart phones that were all leading to the same conclusion: rectangular, touchscreen phones with a focus on graphics based buttons to access functions. Now Samsung moves to increase the screen / phone size, hoping to merge Note style devices with cell phones. iPhone 5 will most likely take the same approach. Should Samsung sue Apple if the iPhone 5 has a 4.8" screen and slimmer case? This is just ridiculous.

Lol...this is the real world! Every manufacturer copies one another to some extant. Its just the way the world works.

I mean look at TV"s these days, they all look the same with different names on them. Its just the way it is.

IMO ...Apple is being ridiculous and taking this a little bit to far. In 2007 nobody could touch them in reality , now a few years later and they feel Samsung inching up towards them, so what do they do? Do they change the game again and bring some new kick ass iPhone designs to the table? No, they just keep releasing the same tired old looking device.

Honestly...its all a big giant joke.

To be honest, who WOULDN't be hell bent on beating Apple? If you beat Apple, it means you are #1 in the world for mobile sales (Which by the way, for 2nd Q, TWICE as many phones as Apple)

How many smartphones does Samsung have for sale? And how many iPhones are there, just 3 (3GS, 4 and 4S). Go figure why it's so easy for Samsung to have more "accumulated" number of units sold/shipped. Because if it's just the Samsung Galaxy S Series versus iPhone, then we know who wins!

@ Paxton Petty: Not sure how accurate this Wikipedia article is:

2011 Overall

  • Nokia 422 million sold
  • Samsung 314 million sold
  • Apple 89 million sold
  • LG 85 million sold
2011 Market
  • Apple iPhone 4, 30 million sold
  • Apple iPhone 4S, 25 million+ sold
  • Samsung Galaxy S2, 16 million sold[46]
  • HTC Thunderbolt, 15 million sold
  • HTC Evo 4G, 14 million sold
  • Motorola Droid Bionic, 13 million sold
  • Samsung Infuse, 9 million sold
  • HTC Droid Incredible 2, 8.1 million sold
  • Motorola Droid X2, 6.5 million sold
  • Samsung Galaxy S, 5 million sold
  • HTC Sensation, 5 million sold
  • Samsung Galaxy Nexus, 4.4 million sold
  • LG Revolution, 3.1 million sold
  • Motorola Droid RAZR, 2.8 million sold
  • HTC Inspire, 2.4 million sold
  • Apple iPhone 3GS, 2 million sold
2012 Market

  • Apple iPhone 4s, 20 Million
  • Samsung Galaxy S3, 10 Million (in two months)
  • Nokia Lumia 900, 5 Million
  • HTC One X, 2 Million
  • Samsung Galaxy S2, 1.7 Million
  • Samsung Galaxy Nexus, 1.5 Million
I don't think it's at all a stretch to say the Galaxy S III will be #1 by the end of the year - even with an iPhone 5 release. The SIII is currently reviewed as the #1 phone in the world (Tech Radar, CNET, etc.) and early sales are pretty exceptional considering it only came out last month. Android has also become the #1 OS and now has a fully diverse / reliable app list for pretty much everything.

Who knows - maybe the iPhone 5 will sell 40 million in the last quarter. I doubt it though.

It seems to me that Steve Jobs started this whole thing when he announced he wanted to declare thermonuclear war on Android because it was a 'stolen product'.

Yet here he is in 1994 quoting that 'Great artists steal' : http://www.youtube.com/watch?v=CW0DUg63lqU&feature=youtube_gdata_player

I still have no idea why Samsung have not been able to use the first quote in the case as it seems quite apparent to me as to the sole reason Apple have embarked on this destructive path.

The trial's due to begin Monday I believe - also my birthday. It'll be a real nice birthday present to have the case thrown out then, but I have as much chance of that happening as I do of getting a Bughatti Veyron SuperSport from the wife...

meh. name a hot consumer market where the top few companies aren't trying to out do each, often by stealing each others ideas, copying each other, hiring each others top management or even lower level employees away, spying on each and on and on.

Apple wants it both ways, they want to protect their patents, but they want to be able to use other people's patents for free. Personally I think software patents, for the most part, aren't that great of an idea.

I'd rather Samsung give me back the full price I paid for two S3's, TWO! As a customer trying something new (coming from an iPhone which was quite original), I expected "everything" was fresh and I trusted Samsung to be "innovative" and not "solely intent" on "destroying" one of the world's greatest tech companies. This may be business and all but it would feel good to know that you are supporting an honest company.

I've heard similar arguments from friends. It's just hilarious how blind some people can be when they are solid fanboys of a company. If you read about how wasteful Apple is their legal battles, especially against their own consumers, you would definitely think it not an "honest" company.

And as far as fresh goes, the only part of the Company that is fresh is their marketing campaign. And even that's predictable. I was a Blackberry user for years and everytime my friends got their new iPhone I couldn't believe how ancient (in modern technology years) the "new" features were. "Oh but this one you can mulitask!" .... Wait? You've had a "smartphone' for 3 years now and just now you can use more than one app at the same time?? "But this one also has LED light to notify you of missed calls." I started to feel like a broken record when they would take about the new features. "My Blackberry from 4 years ago could do that." I bet I said that 100 times each time apple released their new release.

Not to hate on people who enjoy their product. If it suits you, then that's just fine and dandy. I am just amazed that people still think they are 'state-of-the-art'. Everyone copies from everyone. One company may be the first to have one or two new features, but in a year or two's time they all adapt and have that same feature. That's just the nature of the beast. You snooze you loose. which is what has basically happend to RIM....:(. But for the longest time they were so far ahead of the game. It's a shame.

One last and rather damning piece of evidence against Samsung is a document that says that in seven out of the thirty Best Buy stores that Samsung surveyed, the main reason for returning Samsung's tablets was that people bought them thinking they were iPads, thus proving Apple's original point for suing Samsung.

The only thing i can conclude from this, is that most apple users are morons, if you confuse a box labeled samsung with one plastered with apples, the only conclusion must be that you infact are a moron.

Im no fanboy of anything, i have owned an iphone for many years, a 3g wich became absolutely useless when ios 4 came out, now ive got an android phone and so far im loving the freedom.

I feel apple are calling the kettle black. Their business is based on taking an idea/ product that is already available and making it better. I admit they have done it well and pushed innovation but they cannot now go around saying everyone is copying them.

Also on the point that Samsung wanting to out perform damned of the iphone, well yeah, no one aims for second best. It is business! And lets not forget Steve job's personal vendetta against android

IMO all these Court cases need to stop and the patent system needs an overhaul. Only the lawyers win. All that money could be spent on r+d and reducing the cost of my next phone

translation:

we cant compete so we have to resort to suing companies for doing things that we ourselves have done and every company has done since the beginning of time.

no idea is original. ideas have been emulated and improved upon since the existence of ideas.

apple ruled the roost when they came out with their portable mp3 line of ipods. they were #1. but its easy to be #1 when you're the only 1. they were like nintendo in the 80s and baseball in the 40s and 50s.

now they've stepped into a fierce mobile phone market where they are no longer the only one out there and they actually have to COMPETE. they cant do it and are loosing badly and instead of coming back harder they try to sue everyone.

this happened to nintendo when sega came out with the genesis. sega was kicking nintendos arse all over the block with the genesis and nintendo took forever to come out with the super nintendo. by the time they did it was too late. sega had a stranglehold on the market. then sony came out with the playstation and it was a wrap for nintendo's reign in the home videogame console world.

the same thing is now happening to apple. they owned the tech world for a good 5 years due to the fact that they cornered the portable mp3 market. now that the portable mp3 market has been made obsolete by the smartphone market apple now has to step in the ring and box and suing samsung over this crap shows they cant take a punch.

the king has been dethroned.

That is a disadvantage for individual smartphone sales, but an advantage for the company as a whole. Individual phone sales won't be as high as the iPhone as there's a lot more competition even from Samsungs own devices. Some devices are similar to each other, so the sales will be shared amongst similar phones rather than just one.

If there were 50 variants of the iPhone, no single iPhone would have sales like they do now, they would be spread out just like with Android devices.

Correct. IOW companies like Samsung give the consumer many choices, Apple buyers have extremely limited choice. Personally, as a consumer, I like the idea of varied choices.
