I may be misunderstanding your question. That lockscreen doesn't like mine. I had that wallpaper to start but haven't ever seen that red lock looking thing you have there.
Where's the Home button? There should be a physical Home button between the Settings and Back buttons. Looks like a fake Note 3 to me. Did you take those pictures in the dark? If not the bottom bezels way to wide to be a Note 3.
I've spent at least 3 HOURS researching this- more time than I have spent trying to familiarize myself with my own phone & that's for several reasons- I love helping others & I've NEVER seen this on any phone before.
#1) I am going to give this my best shot cause the OP left us with little to no info regarding their phone so helping is the equivalent to trying to find a needle in a haystack.
#2) OP says the phone was just rec'd & looked like this at power up. Hopefully the OP turned the phone off & powered it up again to see if that icon remained.
#3) I came across ONE post throughout all of Google that mentioned the dock - Notice the OP has TWO phone icons in the dock? Also without the OP here to answer any questions I am wondering what happens when they try to unlock- does it go to an additional lock screen- like there's a screen behind a screen?
#4) The OP didn't say whether or not they tried a factory reset.
#5) I do not have a clue where the OP resides but when I started up my phone I don't recall the date displaying as 01-01-2013.
#6) If the OP bought this phone from someone they may have pulled a fast one.
The second phone icon looks like a call log of some sort to me.
The resolution looks low because there appears to be a crappy icon pack installed into a half assed theme on the phone, and it's a shot from a camera.
The phone is probably rooted with either a custom rom installed or just a bad theme. As mentioned above a screen shot of the settings-general-about device screen would probably help.

Try posting a screenshot of the settings-general-about device screen.
A few better pics of the phone in good light will help too. An easier way to get a good screenshot is to pull the s-pen and hit screen write, then save it and upload that if you can. It would be a lot sharper.
I don't know how someone could fake an N3. There are only a few devices on the market with a screen this big.

This is a pretty obvious clone. The resolution is not the same, the icons are not the same. Just look on Ebay at the $100-$200 Chinese note 3's if you want to see some more examples.
I don't have a clue what a cloned Note 3 looks like & based on the OP's poor pics we had little to nothing to go on for the exception of that red padlock.
I've only had my Note 3 less than 24 hrs & have that same wallpaper minus the padlock yet I've done the best I could!
Like I said, *I* searched for a minimum of 3 hrs and this is the ONLY thing I came across with some similarities to the OP's issue.

No offence implied but we were trying to help as well. Some of us were able to immediately tell that the phone was a fake. You said yourself that you don't have a clue what a fake looks like. We were providing information to the original OP that he can use how he wants. I'm sorry if the truth scared you or him but that doesn't change the fact of what it is.
