A whole of M7s were sold after the M8 came out based on that same thing.Someone had a valid argument. If you are looking to upgrade as a non techie, why buy the M9 when you can get an M8? They look the same but one is cheaper.

I think that retaining the form factor and overall look from year to year is a smart play by both Samsung and HTC.
I don't think that most people upgrade their phones every year. I do think that a lot of people either go to the store saying, "I liked my old one, I want a newer, better one just like this last phone that worked so long," or, "I hated xyz about my old phone, I want one like my friend has, it's better."
In those cases, the similar looks pay off, and make it easier.
For those wanting a looks reboot, there's no guarantee that what the makers would attempt will be acceptable. Look at what happened not long ago with HTC. Comments here and elsewhere were pretty consistent - stop changing cosmetics, make a better phone.
So a looks change could hit it out of the park or could backfire. Meanwhile fans from both sides (or pick your own brand favorite, my point still stands) will attack the other side and complain that only their side is being attacked. Just like in sports, and frankly, I don't see much difference on that.
As for listening to us and building the perfect phone, that's never going to happen, in my opinion.
They already know how. If they do it, they'd never have reason to change - and would leave us right back to here and now.
Anyway, that's what I think.
HTC bottom line is to sell a great product and to profit. I believe in 3 years they were only able to successfully turn a profit last year. As a company who was on the brink of bankruptcy, you cannot give people the same flavor of ice cream 3 years in a row. Hence the backlash and phone sales will diminish. HTC can't afford to get it wrong.I completely agree that most people who upgrade just want a newer, improved version of the same phone and not a complete design rehaul. HTC has a good design, and by keeping the design they improve on the recognizability of their brand.
However, I do think they could/should make some improvements such as less space devoted to the speaker grills and the black bar (although they may not have much choice there). I don't think changing to a square camera cutout and moving the power button are enough changes after 2 years of the same design.
Sure, keep the overall design element, but make enough external changes to make the upgrade look worth it. It's a very fine line to toe, and HTC missed it this year.
Edit: Also, what the heck. HTC can expand their midrange lineup to increase revenue, but they can't enlarge their current flagship to make a phablet version? There's no logic behind it.

I wasn't implying their previous designs or phones over the past couple of years had anything to do with the company not being profitable. I was just saying they weren't in a great spot until last year, but this phone (M9) doesn't help them turn the corner if that was their goal. HTC is not going to increase their market share, profitability, or surpass the competition with orange sherbet ice cream three years in a row. They were absolutely black and growing fast until the Apple customs embargo of 2012 - the press had a field day, declared them unprofitable when they were, and then the buying panic took over and drove them straight down.
The entire, long episode had ZERO to do with quality or buyer preference or design complaints.
So - yeah, out a long history beginning with the first Android ever, they had two bad years brought on by Apple.
For patent infringement. For things that Samsung and Google phones still do and that your PC has done since before the Apple attack.

I upgraded to the M8 last year. Only thing I didn't care for was the color of the phone. Better battery than my M7 and I don't take a lot of pictures. So I didn't care about the camera. Until I started using the camera to take pictures this year then I learned trying to zoom in on a picture was bad. I could see why people hated the camera. I don't need a bigger battery because quick charge 2.0 works like a charm. I just thought the phone needs a new face so it can grab the Samsung crowd because I think a lot of them are on the fence with Touchwiz. Sense runs very smooth in comparison from what I hear.Fair enough - but the rapid fan blogosphere would bitch if HTC were hung with a new rope.
Personally, I think that a lot of them hated Android when they owned iPhones and hate HTC now that they own Samsungs and Nexii.
Then add in the massive Samsung astroturfing we have to put up with shaping the viral thoughts.
