My battery burning

What of it? 41 Celsius is hotter than optimal, buy it's a temperature that can easily be reached if a phone is used heavily(and that's before we consider what the ambient temperature is). Using it while charging will make that particularly likely. But it's not "burning" by any means.

At some point (I'd expect by there, but it depends how the manufacturer has set it up) it will start to throttle the processor to reduce the temperature.

If you think you aren't using it, what's the environmental temperature, are you charging, and what's running in the background. The screen generates heat, downloading generates heat, processes running in the background generate heat. But in itself 41 is warmer than it should be if inactive, but nothing to worry about unless it persists, in which case you should look at what is running.
