Class Action Lawsuit against Samsung over Froyo

    I'm sure this will be every bit successful as the lawsuit over the Moments flaws. Samsung will be so intimidated, they may only release 15 phones, 6 microwaves, 23 tv's, 4 dvd players, 3 refrigerators, 7 camera's and a few media players today.

    Won't be long before phones come with a warning sticker attached : WARNING: This phone may not receive timely software upgrades. That way people can't sue...Kind of like the warnings on bags of airline peanuts that say they are processed in a facility that processes peanuts.

    As much as I'd like Froyo I did what I do when I buy anything...I buy it for what it is...not what it might be. And in the case of the Epic I bought it because it was a huge improvement over the Moment...even with 2.1.

    If I had the money I would do it too. I had the samsung epic and loved it but let it go cause it didn't have froyo besides the added bulk of the keypad. I would love to try samsung again but buying a phone as is without guarantee of future support prevents me from purchasing one. If this will shake them up just a bit and make them be more pro active with supporting their products then I think this is a good start. Obviously nothing else is working.

    ... if enough people would not buy from them.....the next big samsung phone will be a big flop... then they will pay attention.

    but if they can sell millions .. by making shaddy promises.. what do you think will happen next time?

    This. What people fail to realize time and time again, is that 80-90% of the country does not have any realization of the flaws we have found in the phone, or that 2.2 is a must have. Just like 80-90% of the country does not know(or care) about the difference between AMD processors and Intel processors. They buy dells and HP's(regardless of processor), which do everything they want.

    Though it sucks for us techies, the masses buy the Epic and love it. It has a beautiful screen, it texts, makes phone calls, surfs the net, and runs apps and movies right out of the box. The companies are not going to cater to >15% of the masses. So I suggest you do what Jason does, and buy your electronics for what they are, and not what you want them to be. Or, install a ROM and be happy with it.

    "Soon" is not a legal term that defines time. "Soon" can mean anything.

    Now one can point out that they promised they would deliver the update before the end on 2010. There may some merit in that argument.

    Still, what outcome does the plaintiff want out of this lawsuit? For Samsung to release an update before it's ready?

    Now if they can prove that Samsung is purposefully holding the update back so business reasons, then they might have a case, but the fact that they delayed the update itself doesn't give them a case.

    If this were to be true then they would have a case. Because it has been stated that froyo is ready but they are waiting to release it until the their 4g phone is ready for release..

    not that I agree with this law suite...

    Soon is a relative term.
    and the life cycle for a cell phone for a manufacture is about a 1yr, before they release something better. so....

    does soon =
    1 yrs? NO.. full life cycle
    6 months? NO.. half a cycle
    3 months? yes... that sounds more what Soon would mean in this situation.

    and remember.. they did say it would be released by years end (2010).

    We seem to forget that *we* drive the business, not the companies. If we are educated and stop buying, they stop making money or, change their practices. It is bringing pressure to bear that motivates change. When we tire of spending $400 for a phone that is DITW at 6 months and crippled with overlay, we will start doing things differently. They are strictly concerned with revenue. When that is adversely affected, they change. Period.

    FWIW I don't think the case has anything to do with what the masses think or want. A class action lawsuite should provide compensation for everyone effected, irrelevent of whether they were aware that they weren't getting their money's worth prior. I think the issue is in defining what a reasonable release time for the froyo update would be. I assume they will make light of the fact that phones like the EVO have had the 2.2 upgrade for months.

    Are you SUre it says PEANUTS and not just NUTS? Not stating you are wrong, but I have seen many a peanuts package and they all seem to say that they rocess nuts, not just peanuts. Being that there can be many different nut allergies, the latter seems more logical to me (and as I said is what I have seen... admittedly I can't recall what exactly the airline peanut packages say).

    So, if this logic is legal in front of law, we can hope that the companies will not do the "soon" think if they cannot deliver it. Hope better "soon" marketing in future!

    I think the guy knows he isn't going to win anything. I think he is just trying to let Samsung know people are pissed that their updates are taking so long.

    This really should have happened with the Behold II. There is video of Samsung telling everyone that the phone would go to 2.X when it was released. They reneged on that and said it would only get 1.6.

    I can't understand this defeatist attitude that everyone has with saying that we should feel lucky to get an upgrade or that it isn't necessary or most of the people don't care. The fact is the landscape of phones is changing. You certainly wouldn't buy a PC or a Mac if the companies said there's never going to be any updates for security flaws, performance issues, or compatibility problems. Android is a full fledged operating system and should be treated as such. This mentality that the manufacturers have is laziness and greed. Consumers are locked in to two year contracts with the phone they buy and unless they switch carriers or buy unsubsidized, they'll never see anything new.

    If Google never released anything new for Android, then fine, but Google is rapidly updating their OS to make it more functional and appealing. The least we can get is timely upgrades for the very expensive phones we purchase. I may root, so a lot of this doesn't involve me, but if the public can expect updates and upgrades from Microsoft, Apple, random Linux derivatives, etc. then they should get the same treatment with Android.
