    I don't get what this is about. You should have posted more info here. Are you after source code, kernels, a new update? What are you going for?

    For the record I looked at the link. The phone functions fine, with some tinkering. If you lose the case, and probably will, you'll be smacked with Motorola's massive legal fees.

    Good luck though, I'm interested in what will happen here.
     
  3. While you are correct to question what type of relief "MEBLESSED" is seeking you are way off the mark concerning the Moto Triumph & the hardware & software issues that plague it. Earlier this afternoon I called Virgin Mobile to request what will be my 10th replacement in less than a year, all for the same problem. The very problem listed on the link provided above. Charging issues. The phone was obviously manufactured poorly & followed up with zero quality control for this to be a reoccurring theme. Lets not touch on my constant inability to get a solid connection via GPS without the phone slipping into 1x territory rendering the phone 99% useless. Oh, and the Bluetooth you can forget about. Its never worked for more than a minute into the call. As far as relief is concerned it would be a no brainer for any judge. Fraudulent claims come to mind as the Bluetooth & GPS are featured selling points. All you would need to do is duplicate the issues with the phone which would be a breeze because I check them daily hoping a patch got pushed to the phone. With my well documented problems with the piece of junk I'd be a shoo in.

    After I became incensed by the dismissive & aloof attitude from VM's customer service I contacted someone directly with Sprint. A lady i had been dealing with concerning the phone back in May. She is with Sprint's Executive & Regulatory Services Group. She told me that they are well aware of the problem & the honchos at Sprint have offered what they think is a "compromise". A replace phone of a different make & model. Option 1: LG Optimus Slider, #2: LG Optimus Elite, #3: HTC One V (all serious downgrades specification wise) & #4: A $100 credit on my account to offset the price of a new phone (an insult)t. I've decided to decline their offer. Small claims is more my speed. I could only imagine that $100 would be somewhere in the ballpark of the settlement per person after the attorneys get their hands on it. I'm currently looking into the steps needed to file here in Philadelphia, PA. The phone would only need to continue doing what it does on a daily basics for me to succeed. I will keep posting my progress here. Anything less than a full refund is unacceptable in my eyes.

    But who exactly would yous try and go after, cause technically the phone isn't Vm or Motorola, its a huweugi or whatever phone that Motorola paid to put there name on and Vm just happened to get the short end by providing service for

    Of coarse there is probly rules and third party sales regulations, but everyone would probly just blame one another

    Not in anyway trying to start an argument or anything, just curious myself while throwing some info I know out there

    Before buying this POS you should have read up on the issues it has,there is no denying your complaints,but no one forced you to buy it,what cracks me up is they are still charging between 150-200 for this 25 dollar mistake,good luck with your lawsuit.

    I wasn't attacking anyone. As for the patch I mentioned, it was through our development community. As far as Motorola is concerned, they realized their error and offered, through Virgin Mobile, to replace all defective units through the one year warranty. Once that's up, they aren't responsible for you not getting in on your replacements. They sold the phone, and are liable for replacing them until you get a working one, but short of that, you have no case.

    You know who makes out in class action lawsuits? The lawyers.

    Even if you found a firm to go through the enormous expense of establishing and filing a class action suit, all it would do is languish in court for years and years and years, while the lawyers line their pockets billing thousands of hours to the case. And even if the class wins, after the legal fee's are covered, most people in the class action usually end up with a $25 coupon or something.

    very true. We live in a sue-happy country where everyone wants someone else to give them stuff for free or at no expensive to them. the only people who REALLY benefit from that is the lawyers, and thats because they are smart enough to know how to really work you over and wring you dry. this is a survival of the fittest world, and the people at the top have the brains to steal from each and every one of us every single day. your notion of starting a class action suit is exactly what they want. bet they wish everyone was like you * "you" refers to the original poster. didnt realize I quoted someone else until after my rant. haha

    Specifically because of this pos phone Virgin actually changed their TOS preventing anyone from bringing a class action lawsuit against them, you are limited to arbitration and can't be awarded an amount greater than the purchase price of the phone even if they knowingly sell you a defective product.
