It's a bit naughty if they're selling you a used phone as new but, if they've offered to exchange it, I don't see what else you expect them to do. Accept their offer and check the new phone thoroughly before leaving the store.

Ya I didn't check that 1 biggest mistake. I'm going there tmr try to get a new 1. But the said when I called the phone should have problem for us to exchange to new 1. Thn if they don't exhange I'll say I don't feel comfortbale with used open boxed phone.

looking at it from a legal point of view, i understand that the box was opened when you got it but you can't prove it and if the phone is working then it will not be replaced.

one question, you took it to five different unlockers and they said that it can't be unlocked because it is refurbished? why not? it still has the same hardware/software.

If you don't get anywhere with that, there are online outfits that claim to be able to provide unlock codes for any Desire. Search the forums for more info.

If you got it from a brick and mortar store, it's possible they just opened it up once to demonstrate the unit to someone then put it back and forgot about it.

Leave Rogers and come join us over at Telus, then you won't need to worry about getting your phone unlocked.
