HTC EVO 3D help!

So I recently just got this phone for Christmas and it wasn't updated to the Ice Cream Sandwich Update. So when I tried to update a white triangle and yellow exclamation point appeared. So what do I do to get my phone to update. Is it rooted?

If your device is supposed to be updated through an OTA update then it will be up to your carrier to release the update to your device.
