I am probably getting scammed on Amazon..

    So I was selling an Xbox 360 Street Fighter 4 Arcade Stick "Tournament Edition" I listed it as used like new and forgot to mention that it does not come with the instruction manual and wire to plug a headset attachment.

    So someone buys it and the day he receives it files an A to Z claim saying it doesn't come with the manual and wire. I haven't checked my email for a week cause I've been busy and now the claim has been won in his favor.

    He's now got his money refunded to him and he still has my item. According to Amazon he is supposed to return the item so I sent him an email apologizing for not listing the item properly and not getting back to him quickly and asked him to return the item.

    I have to wait 5 business days to give him time to respond before I can tell Amazon he isn't responding where they can then do nothing to help me but to just tell me to keep in contact with him.

    I also just got off the phone with a representative from Amazon's Seller Department and according to what he told me, seriously not a joke. That someone could buy a "Used Like New" item they can receive that item and say "Such & such cord is missing" and according to Amazon it then would not be "Used Like New" because according to them "Used Like New" means it comes JUST LIKE NEW WITH EVERYTHING IN THAT BOX. They can then file a claim, get refunded their money and get away with keeping that item.

    I'm in a terrible mood right now, so upset because I just know I can feel it that I've been scammed.

    I'm going to try not to sound like an authoritative figure here since I'm probably not much older than you.. but you gotta be on your game when you are in the business world! You can't just not check your e-mail for a week.

    Amazon is a top of the line company and I'm not surprised they are this strict with their private sellers. The reason Amazon is a top business is because they don't allow sellers to just do whatever they want. Customers come first. I really don't think you got scammed.

    "Please allow three business days to give your seller a chance to address the issue. You can submit a Guarantee claim if the seller does not respond or if the issue is not addressed to your satisfaction. "

    You didn't respond until a week later so clearly you violated their policy.

    It happens. Customers have more rights than sellers. That's how it worked. My friend was a listed seller of cellphone on ebay with over 1000 satisfied customers. One day a new customer got ticked off for no reason and just decided to give her a bad rating, and her account got closed. All those built up reputation just gone in one night.

    I had about 40 positive ratings and 1 bad rating (which was STUPID because she didn't like my packaging, even though the product arrived in perfect condition) and my account was closed.

    I'm not sure about Amazon, but I know eBay has both seller and buyer protection policies to protect both from misconduct. Before eBay issues a refund to the buyer, the item has to be shipped back to the seller.

    If a person has had an account suspended, then they must have violated a policy (failure to pay for an item, failure to pay seller fees, listing conterfeit items, etc.); eBay does not ban accounts based solely on negative feedback.

    All of eBay's policies are listed when you sign up to use the site (as I'm sure they are with Amazon's as well), so everyone that uses them should make sure they understand those rules and policies 100% before they start complaining that they have been banned for no reason, or in the case of the OP, scammed (as jamor already pointed out).
