So my phone was dropped by someone i know while they were holding it for me when i was on kingda ka, and since they wont pay for it, etc...blah blah. So I have rooted my phone and have a theme and virtuous rom 3.0.1. If i just put the sd card with my nandroid backups into this new phone im getting (another incredible) and do a nandroid restore, will it all be restored on the new phone, or does it matter if its a different phone im trying to restore on?
    Thanks

Yep, should be fine once you get your new phone rooted.

Bear in mind that your new phone and the old one (if it's repaired and sent out as a refurb) will likely share the same android_id. This means that apps that you purchase can inadvertently be pushed to that phone as well as them messing with your apps. In short, it comes with certain risk.
