No matter how you slice it, tort reform will have zero impact on health care costs. I choose to trust the justice system (judges and juries) that is a fundamental part of our democracy.

You can't use the same measure for both. "per capita" counts all 300 million americans, and therefore would assume they're all doctors or persons involved in malpractice suits. The ambulance chasers love this type of "statistic", because it minimizes their adverse impact on the medical system.

Per capita is per capita; both numbers use the U.S. population in their divisor. The $12 figure comes from a peer-reviewed study. I've seen figures indicating a 0.46% reduction in health care costs resulting from "malpractice reform" as well. Either way, your approach has negligible impact. Period.

Is it your position that physicians never commit malpractice, or do you believe that they should pay no price for negligence, laziness, or other misconduct? Bad doctors will pay excessive costs and be driven from the profession. Good doctors will thrive. It's the market at its finest. Why do you hate capitalism?

We have judges and juries to sort through these types of claims. They are a fundamental part of our system of government. Why do you hate America?

I'm a surgeon. My overhead costs to run my practice are around $25,000/month. Many surgeons in my field don't take Medicare because it doesn't pay enough to make it profitable. The democrates want to cut Medicare by 500Billion. They want to cut payment to doctors and hospitals. You are going to see a lot more doctors refusing to accept Medicare with cuts like that. I can't pay money for the privalege of going to work, and I work way to hard to not get paid well. I frequently get paged in the middle of the night by patients, nurses, you name it. I'm on call a lot to cover trauma and frequently have to go in at night (still have to work the next day), miss dinners, parties, holidays, weekends, etc. Half the time I'm so tired I feel sick. I'm missing the best years of my life and loosing out on watching my kids grow up so I can help others.
When Medicare was started in 1965, they predicted how much it would cost by 1990. They were off by a factor of TEN!!! You think the current plan is only going to cost 1 Trillion!?! It will end up costing much more, and our children will be paralyzed by the debt this administration is racking up. They want to cut payments to hospitals, but they are struggling already. Hospitals already loose money on every knee replacement patient. Soon they will refuse to let those surgeries happen in their hospitals. Obama says he won't tell you what doctor you are allowed to see. He is just cutting reimbursement so much the doctors will refuse to see you. I'm a softy, so I actually operate on a lot of people with no insurance for free (meaning I'm actually paying out of my own pocket to cover their associated overhead costs). The government doesn't allow doctors to take a tax deduction on the charity work we do (that would get alot more doctors willing to give free care). As for other countries - Canada and Europe are a distaster. I attend large international meetings ever year. Doctors from Canada say that there is now a one knee replacement per knee per lifetime in Canada. Knee replacements wear out, can get infected, etc. Not to mention that patients often have to wait a year in Canada to get their total knee. There is a reason wealth Canadians come to the US in droves for health care. As soon as I get my Droid, I'm getting the Obama app. The next election can't come soon enough.

If anything it looks like because my work pays some he will have to pay more which in turn means he wont be able to give it to us anymore. We wont qualify for the government sub. If the government takes 40% of what I EARN, but 10% from my neighbor, that means that I'm a slave to the government 4 out of every 10 days, and my neighbor is only slave to the government 1 out of every 10 days. That is not fair. It is the same as the government going to two different farmers. Farmer one is not very good at what he does, so the government decides to only take 10% of his harvest. The other farmer worked his ass off, did the research, and had a huge harvest. The government says "good job! You did so good, we are taking half of yours!!" Before you come back and say that you should pay more if you make more, realize that if you take the same PERCENTAGE from everyone, you take 10 times as much from someone who earned 10 times as much. The current system takes 40 times as much or more if you worked hard.

I'm 10 years your senior, and I work more than 60 hours at 2 different jobs to support my family and try to ensure that we have what we need. Then Obama goes and says "no tax increase on those making less than (moving target number here...)." and first thing he does is raise tobacco taxes. Well, that's a tax increase. Then they let the tax cuts expire... that's a TAX INCREASE because we'll all be paying MORE. And he wants to tax corporations - corporations don't pay taxes, their customers do... Yep, those of us who make less than 250k, well, we buy stuff from Corporations.

I have a solution!

If you want to live a socialist life, move to a socialist country instead of trying to RUIN and DESTROY the nation we have here with more government meddling and regulation.
