Rogers Dream 1.6 Update

    In the end, it will come to this:

    Rogers will learn from their mistake, and we will get proper Android support going forward.

    OR

    Whether or not we get 1.6, Rogers will fail to properly support Android.

    If it is the latter, we as consumers must be prepared to take real steps to punish Rogers with our business, or lack there-of. If we are not actually willing to do something in the end, then it is a lot of "sound and fury, signifying little" (to paraphrase the great bard). It's like needing to give your child a consequence when he/she is bad. If there is no meaningful consequence, they only learn that they can continue to do bad things with no fear of reprisal.

    As consumers, our options if Rogers refuses to properly support Android are as follows:

    1. Do nothing, and nothing changes.
    2. Stay with Rogers and root our phones, thus voiding our warranty, but allowing us access to updates. At the end of our contracts we can choose to leave, or not.
    3. Root our phones to get the updates we need, and either demand to be released from our contracts, or pay the fee to be released if we can't get out of our contracts. At that point with option 3 it would be helpful to have the opinion of a contact lawyer, either to see if we have grounds to be released from our contracts, or to see if it would satisfy the requirements for a class action suit in Canada.

    If enough Android users are willing to take their business from Rogers, they _might_ take notice.

    Can anyone get some details on the actual fees to severe the contract? Or if we have grounds to be released from the contracts? Opinion won't do us any good here, we need to know for sure.

    Attention Rogers: if you're reading this, maybe you won't care, but we are seriously considering these options. Most Android owners are proud geeks, and we don't give up on these things. We also know how to use this thing called "the internet" to communicate with others, research, and disseminate important information; like that potential Rogers customers should reconsider buying Android phones from Rogers if they aren't going to be supported.

    From Rogers's Personal Plan page (click on "Legal Disclaimer" at the bottom of the page) :

    Code (Text):
    1. The ECF is the greater of (i) $100 or (ii) $20 per month
    2. remaining in the service agreement, to a maximum of $400 (plus
    3. applicable taxes), and applies for each line in the plan that is
    4. terminated. In connection with your wireless data service, a Data
    5. Early Cancellation Fee (DECF) also applies if, for any reason,
    6. your service is terminated prior to the end of your plan's
    7. commitment term (Data Term). The DECF is the greater of (i) $25
    8. or (ii) $5 per month remaining in the Data Term, to a maximum of
    9. $100 (plus applicable taxes), and applies in addition to the ECF
    10. for termination of your service agreement. If you subscribe to a
    11. plan combining both voice and data services, both the ECF and the
    12. DECF apply.

    I guess we could go through the list and see what we can use. I haven't had time to read the whole list though.

    So the cost for most of us to get out of our contracts will be $500. To put that in to perspective, for those of us who signed up for a new 3 year contract to get the new android phones, that would be about $2160 over 3 years (based on $30 for voice and $30 for data).

    We also need to find out about getting out of our contracts legally without incurring the fee. Does anyone here know a lawyer who might be able to tell us with out paying expensive lawyers fees. ;-)

    So has anyone actually written an email to the Office of the Ombudsman yet? I am wondering if that will bring any other results.

    Because this tread has been mostly about HTC and a little about the LG Eve, I have been quiet, but, just to asure you guys, I have emailed LG and got this:

    So...I replied to them and haven't recieved a response yet. I want to say that the Eve is an awesome phone. I am having a blast with it, but, just like everyone else, I want the newest versions of software possible to get the newest apps. I am joining the petition and hoping this get resolved for us android users.

    Wow! A flat out no?? Man that kind of answer just makes my blood boil!! How can you release any kind of hardware and not update it?

    Best of luck and I hope you get a better response from LG on this one.
