It looks like LG and Rogers have decided the following:

    - no Android upgrade to the LG EVE OS.
    - No Hardware upgrade to HTC Magic
    - No Communication on this topic...

@RogersMary has been asked several times to comments on what Rogers is doing to LG Eve owners. She has yet to make a single comment. Silence is Golden

LG sends the same canned replies "We have no information on the upgrade"

"Silence is golden, but my eyes still see
    Silence is golden, golden
    But my eyes still see"

Movers and shakers what should be done?

I'll quote myself just to say I told you so. This one will be a little bit different since the Eve is a lower priced phone. But the precedence has now been set.

Can I get first dibs on a Dream once someone has one left over without a SIM?

Folks, the celebration for winning the first leg of the battle with Rogers / HTC is going to be postponed until we also win over LG and make sure that Eve users are provided a similar upgrade (software or hardware).

    CELEBRATION POST-PONED UNTIL FURTHER NOTICE

Great PR move on Rogers part. Offer up something to "solve" what people are complaining about while keeping them as a subscriber longer.

This may work for some people, but it doesn't work for me. I'm paying $140/month for 2 Dreams. I'd have to slap on another 7 months, that means I'll be paying an extra $980 which could buy a really nice unlocked phone (N1, X10, Droid).

    My options are:
    1) Stick with Rogers for an extra 7 months while paying them an additional $980. Be stuck with a phone I don't really care for (I choose the Dream for the physical keyboard). Also, there is nothing saying the Magic will be supported beyond 2.1; will everyone have to go through this again in a few months?

    2) Get a new UNLOCKED phone with the additional money I won't be giving Rogers, switch to a new carrier of my choice (WIND) 7 months sooner, not be locked into any contract and I won't have to worry about going through THIS again.

Yes, you are technically correct. (but remember, it depends on how long you've owned the Dream. If you got it in promo in December, you're talking only 1 extra month) So, then, that is another option for Dream owners, they could pay $500 to get out of their Rogers contract and do as they please. Of course they are still stuck with a Dream on 1.5, and if they want something better _without_ having to get a new contract, they will have to spend another $600 or more for a newer Android phone, so, yeah, you save a few hundred dollars over the long haul. For those who can afford that $1200 or more right now, go ahead, you are saving money over the long term.

For those who can not afford $1200+ dollars, there is another way of looking at it, that being, if you did not take the deal, at the end of your original 3 year contract you would be free and clear from Rogers, but with a phone stuck on 1.5. You would then, again, be in a position to buy a new phone with no contract for $600+ (depending on prices 2.5 years from now, who knows?) or get a _new_ contract to get a subsidized phone.

So, if you can afford $1200+ dollars _right now_ (maybe you make really good money, or you have a great interest rate on your credit card or line of credit) you're probably better off buying out your contract and NOT taking this deal.

OR Someone correct me if I'm wrong, but I believe the max contract buyout is $500. So you could take the deal now and sign up for the extra months. You get the Magic for no extra cost. Then you buy out your contract for $500. You now have 2 phones for $500 and you are free of a contract. Hmmm... pretty sweet deal if you can afford it.

Got my upgrade, the Magic is on its way. 1st Level support knew about it (last night the fellow did not), but 2nd level had to help me.

Still not available on my online account, bizarre.

Aren't those abandoned Dreams still useful? If anyone in the T.O. area wants to give me one I'll have a device to try out different ROMs on. I should be able to update it like we can with the Magic. Free or cheap I'd like to have something for funzies.

While I'm happy and ready to help in a just cause; as an HTC Magic owner, I'm not sure I'm a the best representative.

I believe that LG Eve Owners should send emails explaining and complaining about their situation. They should refer to the HTC Magic software upgrade to 2.1 and also to the HTC dream hardware upgrade offer.

They should also do some calling. Typically phone calls are very interactive. Even if one talks to the wrong person, they will eventually get transfered to the right one. If you call ask for PR department or customer relations dep.

Since you (mjschmidt) have been acting as an un/official rep, you should email LG on behalf of this group.

So if we get to keep our Dreams and it turns out that it can be rooted all the way up to 2.1 then we are well off indeed.

It seems to me that with the evolution of the software on these devices that taking on three year contracts are fraught with peril. Even with my new Magic coming in the mail it probably won't get much past 2.1 and I still have to keep it for the next three years. It will be interesting to see how the whole business of long contracts and free phones plays out.
BTW not quite so SorrowFull anymore. Thanks for the hard work everyone, if it weren't for the near rebellion that Rogers saw coming over the horizon we wouldn't have gotten anything.

I have already sent them an initial IWMOPS email. I posted about it (and their response) a few days back, so maybe page 25 or 26 of this thread? Suffice to say it was the usual PR mess.

I'll keep saying it, unlocked phones with no contracts is how it needs to play out. If we are to be labeled as tech savvy consumers then we need to take responsibility and educate ourselves at least to the level we claim on our desktop computers. I don't call my internet provider when my computer is a few versions behind on the operating system. Long ago a provider tried selling computers and that was a disaster and at best the most expensive way to buy a computer. same here.

I believe we will have just that in at least 5 years when PC makers start making phones. We will buy phones like we buy PCs, and get our updates from the PC manufacturers or the OS manufacturer directly.

Mark my words, the providers will sell you the cell enabled pc just like they do now with phones. The Nokia tablet is already sold that way. We'll ask the same questions, "which provider is offering Tablet X1?". The billboard I see every day will change from a phone to a pc and say "3G PCs at $0!!". We'll look at $0, $49, $75.98, and jump on the contract instead of the $500 PC that ours to keep and update ourselves.

But sure, at some point enough people will start buying unlocked phones and that will finally change the industry. The industry and the feds won't do it until they absolutely have to. I'm old enough to remember when people still rented their landline phones.

According to RogersMary. See my blog (post from Jan 12) to see the quote from the email she sent me. Also, no one who has done the exchange has yet been asked to send back the Dream.

OT: Anyone want to sell a US brethren a Dream to play with? Although I'm not in Canada, I've been following, and commenting everywhere, including notifying BGR/Engadget/Gizmodo when word came out about the Dream-to-Magic upgrade offer.

    Pretty please?

I'm on AT&T, and have NO Android choices right now.... :(

I started with an N95 almost 2 years ago i asked to upgrade to Blackberry Bold, i was not eligable, so i bought one out direct, i asked to upgrade to a HTC dream recently(october) was told i was not eligable so i bought out direct yet again, and today when i try to get the HTC magic, i am turned away and told that i can not get this promotion because... you guest it, because i am too loyal to rogers and because they would not let me sign a 3 year when i bought my phone i am not allowed to upgrade to the magic... i used to be a die hard rogers fan, but now i just do not know what to think, because i WANTED to sign a contract and because they wouldn't let me, i am now stuck with paying the "79.99" hardware cost and the "35" dollar system access fee
