Looks like theft to me, she picked up the phone the phone that was not hers, then gave it to the guy who pretended it was his phone and walk out the door.

To top it off did they looked handicapped, well they were also parked in a handicapped parking stop.

IANAL but I'm thinking they removed an item from the store, without notifying any staff or paying for it. Doesn't matter if it's lost property, merchandise or fittings, that's theft.

If they found it in the street, that's a different matter. Although the good thing to do would be to hand it in at a police station.

I was on jury service once, and one of the trials was, two people removed an apparently abandoned item from a piece of land. It was recorded on CCTV. It was an old outdoor light fitting that was just lying there, and the land belonged to a railway station, i.e. private property. They were found guilty of theft and fined.

Wasn't theirs. Police report for theft, and if $400 (which most of these smartphones are) it is grand theft...and a felony in California.
