warranty exchange fears

So prior to ICS I had intermittent problems with GPS and they would usually be solved by rebooting. While it was annoying to reboot, I just didn't use the GPS that much to return the phone. After the ICS update the issue became significantly worst. Rebooting didn't solve the problem and I would say that the GPS isn't working 9 times out of 10.

I went though all the hoops w/ tech support and they have an warranty exchange unit on their way. They did make the following threat to me: If the problem cannot be repeated in their testing, I would be charged a "restocking" fee.

So considering that the issue doesn't happen all the time (but often), how worried should I be that they will try to screw me over with this restocking fee if it just so happens that the GPS works when they try it?

Take camcorder and record the problem on the video. If they going to charge you call them and argue tell them i have a proof and blah blah blah. And you can also request a testing report from them. They gonna have to eat it. Don't worry they say that but they don't do it. Yeah before you going to record you problem make sure you record and include IMEI and serial number in video.
p.s

document IMEI and serial number of your phone before sending it out.
