What is Privacy anyway?

while the phone I use bootloader was trying to be cracked one of our dev came across something our phone did, he noted it logged everything we did to the phone, did on the phone and I do mean all he also discovered this. http://androidforums.com/motion-4g-...g-work-in-progress-thread-30.html#post5895532

I wonder do all phones have this? if they do, why? Is this even legal? if it is how? Can someone fill me in and get a discussion going and find out what phones do this as well and maybe a why. even a way to disable it.
 
I know that this thread was started here because the other discussion got political, however going back to the original, technical issue, what I don't understand from the thread is, first where these 'commands' are located and second - and perhaps most confusingly - when they would be triggered?

Also, does this mean that the commands are on all LG Motion phones or just phones running a particular ROM?

Re triggering: the first list includes things like suicide, violence, child porn, phishing .. How does the phone identify these things and link them to the relevant command?

I mean: phishing attacks don't arrive on a phone conveniently labelled "I'm a phishing attack". How would the phone work out that it needs to run the command about phishing attacks? :thinking:
