I still don't see how it is then legal to use an app that sends an SMS/MMS over your internet connection as a real SMS/MMS to someone else.

This would be one of those apps in question. With this I can impersonate anyone I want. All it actually takes is signing up for the service free of charge.
I'm not positive about that app, but I'm pretty sure all the texting websites, where you can send texts online instead of from your phone, DONT use a real person's cell number. yes, it uses a real phone number, but that's different from these spoofing apps, where you could send a text or call and make it look like you are somebody else.
