Anyone ever bought EVOs AND a line from wirefly? Do you have to activate them or can you use another

    I'm getting conflicting answers regarding what I want to do. I want to add my parents to my line but they don't need smartphones, but the EVO is going to be on sale for $150 and i was thinking about getting two of them for $300 total and reselling each for $350 making $700 and using then buying two flip phones off ebay for $100 each so i'll be making $200.

    My question is, do I have to activate those EVOs on my lines or will they charge me their own fee if I use another phone?

    I've called Wirefly and spoke with three people but with their Indian accents, i couldn't understand or they mentioned SIM cards and i just hung up on them.

    If you downgrade a phone within 181 days you'll owe wirefly $300 per phone. My wifes phone was activated the day of purchase.

    In my experience unless you call on a weekday morning you stand a good chance of getting an overseas call center.

    Wirefly's discounts are based on getting a commission from Sprint, and that's tied to the rate plan you sign up for. If you sign up for a 4G smartphone then downgrade to a plane Jane phone, Sprint will dock Wirefly's commission. That's why there's no free lunch.

    To answer your question: when you purchase from Wirefly you receive an Instant Savings Discount, by accepting this Instant Savings Discount, you agree to repay $200 of this discount ($300 for smartphones and netbooks) and authorize us to charge your credit card in repayment of this amount if, during the 181 days after your new equipment is activated, your wireless carrier notifies us that the services you purchased have been suspended, disconnected, or deactivated, or if you return your purchase outside of the return and exchange provisions of our 30-day Satisfaction Guarantee.

    Please note some of the reasons your wireless carrier may notify us of a deactivation include:

    * You transfer this equipment to another carrier line of service after it is activated
    * You change your rate plan to a lower monthly service rate than was specifically required at the point of purchase
    * You deactivate texting/data features that were specifically required at the point of purchase
    * The new line of service activated with your order is used to replace a pre-existing account

    Contrary to what is said in the quote above, the terms and condition that was stated there does not apply to Sprint accounts (at least not when I bought my Epic 4g on 12/12/10). Such term and condition does not exists for Sprint accounts.

    If you'd like to test this, here's what you do:
    1) Go to wirefly.com and select any Sprint phone
    2) Select any option for purchasing the phone except "Replacement Device"
    3) Add the device to your cart and follow the checkout process
    4) When you get to the actual checkout page, scroll down to the box that says "Instant Savings Terms and Terms of Purchase" and click on the "Instant Savings & Terms of Purchase" link
    5) Review the terms

    You'll notice that there is nothing there that mentions a charge back for disruption of service. Repeat the process above for any Verizon phone and you'll get a different "Term of Purchase". The one I quoted above.

    Now I know that Wirefly is big on us sticking to our contract and this is exactly the loop hole we have. There is nothing in the contract that states that we have to have the phone active for any amount of time except those pertaining to the Sprint contract of opening a new line.

    The bottom line is this...there is nothing in the contract prior to and after the purchase that binds Sprint account holders to such terms and conditions. I for one will be swapping my newly bought Epic 4g with my primary line with the Moment later today.

    BTW...this was confirmed when by chatting with Wirefly's customer support. The first two weren't able to find any term or condition that states that it is not allowed or that a fee will be associated with the swapping of phones. The last one conceded that swapping is possible by contacting sprint. Below is a clip of the last chat I had with Wirefly's customer support.

    Me: my question is, i want to swap the phone i ordered through wirefly with one that is currently active on the same family plan account, normally i would just do this through sprint's website...however, when i was chatting with shirley earlier, she told me this may not be possible but we got disconnected before she was able to get back with an answer.
    Me: my question then is: where in the contract (terms and condition) does it state this?
    Sara: Johan, the order is placed based on online promotion.
    Me: understood
    Sara: You are not allow to use the mobile number that we have assigned for the phone with any other number.
    Me: are you suggesting that i can't use the phone with another number?
    Me: your previous statement didn't make sense
    Sara: On the 2 points of the terms and conditions, it states:
    Sara: The wireless device you are purchasing includes an Instant Savings Discount that reduces the cost of
    the device to you. By purchasing the device and accepting the Instant Savings Discount, you agree
    that for a minimum period of 181 days from the date of activation:
    Sara: you will pay your balance each month in full;
    Sara: you will not disconnect this line of service;
    Sara: you will not transfer this equipment to another [Carrier] line of service;
    Sara: you will not change your service plan to a lower monthly rate;
    Sara: you will not deactivate the email/data feature if one was required for this purchase;
    Sara: you will not transfer a pre-existing number with [carrier] to this line of service unless you are
    extending your contract; and
    Me: actually, it doesn't
    Sara: you will not use this new line of service to replace an existing account with Sprint.
    Me: what you are stating does not apply with a sprint account
    Me: and this is because you are an authorized sprint retailer

    Me: please double check your terms and condition
    Me: you can go to wirefly.com, select a samsung epic 4g and add it as an additional line on your account. change the plan to a family plan with data everything
    Sara: If you wish to keep your existing number, I can update the upgrade request on the same order.
    Sara: What is the number that you would like to have for this phone?
    Me: follow the checkout process until you get to the actual checkout page. then scroll down to the bottom and click on the "Instant Savings & Terms of Purchase" link in the "Instant Savings & Terms of Purchase" box and you'll see that such verbiage does not exists
    Sara: Johan, can you tell me exactly what you want to do on this account so that I can see what I can do to help./
    Me: i want to swap the phone i bought from wirefly with one that is already active on the same account...just a different line and number
    Me: for example, i want the new phone which is active on # 1234567 on line 7654321 and the phone that is currently on 7654321 on the new line 1234567
    Sara: Okay
    Sara: You can do that with Sprint and get back to us once it is done
    Sara: Is there anything else I can help you with?
    Me: why would i need to get back to you?
    Sara: We need to update the number
    Me: update the number where?
    Sara: In our system.
    Me: ok...and if in the event that i don't get back to you quickly after i make the change, will there be any repercussion?
    Sara: No
    Me: is there a window of time in which i need to get back to you?
    Sara: Get back to us via chat as the same way you did today.
    Me: i just want to make where there are not hidden fees or anything when i make the change.
    Sara: No
    Sara: Get back to us once you changed the number.

    so is this true for sprint. I also see that the 2 contracts vary for sprint and verizon.

    I am interested in downgrading my plan to sero-p.

    can I do that without fear of charges from wirefly.

    I would advise that you do not change your plan to a Sprint SERO plan. That would be considered a violation of our terms and conditions. You can see that on our website at: www.wirefly.com/about/purchaseterms/
