Can I backup apps no longer in the market?

Hello, So my MT3G froyo update just got potentially delayed another 45 days so I've decided to do the update manually. How To Manually Update to Froyo! - T-Mobile Community

Thing is in order to do this I have to do a factory reset, and I know of at least one app I really love that is no longer in the market due to copyright infringement. is there any way that I can back this up so that I don't lose it?

Yes, use a file manager such as Astro to backup the app.
