got 2 x Fascinate for my brother and sister, total was like $150 with NE2, and tax was over $100 said it charges be for tax on nearly $1200 ,.. wtf

That would be correct, for living in California your charged taxes based on the full retail cost of the device.

um, well ya, I guess I got 2 fascinate for about $260, thats a good deal ($149 + $100tax) but still,. Ca hurting me lol

Yeah, you live in a state who's govt prides themselves on finding creative ways to tax people. The whole "pay tax on the retail price" really sucks on phones because cell carriers never adjust the "retail" price to match demand or current trends....so something like a Treo 600 still has a $599 "retail" price even though you'd be hard pressed to find somebody who'd sell you one for more than $100. If you live in CA and want to discourage practices like that you just need to leave the state when you make large purchases....if enough people do it, they'll learn that a smaller, fair tax is better than $0.

I live in Cali and have always paid sales tax on the full price of my phones, but when I bought my Facinate yesterday at Costco and went up front to pay for it they only charged me the sales tax on $179.00 instead of the full retail. Ended up around $197. Mistake? There policy? Worked for me! I wasn't gonna say anything!
