This seems almost illegal to me. VZW isn't supposed to be able to dictate like this when some device can be sold by 3rd parties. Particularly if you are willing to pay full retail. I might try a third party retailer today and see what their tune is about selling at full retail. Selling a device at full retail once you have stock shouldn't be something VZW can bother any sorta legal/sales agreement you have with them. I could see them controlling when something is available at subsidized pricing as VZW is paying that subsidy to the retailer.

Uh, yeah they can.

So now that I'm back from my fruitless adventure, I have to ask, has anyone else been more successful than me and actually got to walk out the door with the Nexus in hand?

A few pages back, SamMax got one activated and to home, but had to take it back after VZW threatened the jobs of the employees who had sold it to him.

A very good (wo?)man, that SamMax :)

Finished my epic journey on a heartbreaking note.

I stopped at HHGregg near Abbey's Verizon store. I spoke with the salesman there. He indicated they are in stock, but he can't sell them due to a hold from Verizon. He took my number and said if anything changes prior to the 12th he'll call me.

I returned to my part of Cincinnati (eastern suburbs) and went back to the mall I was at earlier to visit Radio Shack. The salesman there said they have them in stock but the Verizon rep came in yesterday and told them not to sell them until Sunday. I asked if I come back Sunday if he will sell me one. He said gladly. We'll see.

I then went to the Best Buy around the corner from my home. As I walked in I was greeted by a familiar face at Best Buy Mobile. My brother in law's sister works there and I didn't know it. There were about 6 employees hanging out at Best Buy Mobile when I walked up. I was thinking "oh no, this isn't going to be good". After asking to buy the Galaxy Nexus she said no problem. She opened up the cabinet behind their desk and inside were at least 50 of the Galaxy Nexus. I was woozy. She opened it up, got out a SIM card and inserted it. She said she needed to call Verizon to get my upgrade bumped up from 12/28 to today. I thought oh no here we go. Verizon did the bump, fortunately she didn't tell them what the bump was for. She activated my phone and I asked if I could begin uploading my accounts and get it set up as she rang me up. She said no problem. I went all the way through setup and was delighted. She scanned the phone and it didn't take. She punched in the bar code and it didn't take. I knew I was doomed. She asked her coworkers in Best Buy Mobile and NONE of them could get it to ring up. She called a manager. I knew that was it. He pointed out an internal memo stating they are not to acknowledge ANY knowledge of the phone nor disclose any stock. He apologized to me. I accepted graciously. I then did a factory reset of the phone. She called Verizon and returned my phone to my Dinc. I disagree with the sentiment "Tis better to have loved and lost than to never have loved at all". :mad:

Verizon is so incredibly idiotic. The phones are sitting on shelves ready to be sold, and they refuse to release them. But what really makes me sick is that they refuse to update their customers. Why take emails and represent that customers will receive information, when none is provided?

This is ludicrous.

I am guessing that all of you already went and got your GNex today; in fact, I bet that you are posting using your new phone. Verizon has put you up to posting here that there is no release on the GNex yet so that I won't know the truth. I can't believe that you are all in on Verizon's conspiracy against me! :(

Yes I returned it...:( 3rd party, there's no way a Corporate store will sell it today.

That was my first time holding one, I must admit the overall feel is so much better than the GS2, it feels way more solid and more ergonomic and comfortable with no bloat it's so smooth and so fast. I will gladly wait 6 more days.

Hey Sam, I just wanted to take a minute and commend you on your decision. It couldn't have been easy, but I feel like you have done the right thing and respect your ability to put others before yourself.

You've earned some serious Karma points. Kudos to you sir.

i dont know. i never use twitter. but this this trainwreck, i'll do whatever to get some REAL intel. so sick of the smugness of vzw. meanwhile, they are releasing xyboard(thing), more razr commercails highlighting motocast !!!

hey vzw, WE DON'T CARE about that crap. There are loyal customers here just wanting some REAL information!! Enough of the employee scare tactics, etc. Just provide a DATE.

Yes "Street Date" is very common "slang" in retail.

However they don't write the street date on a box in sharpie marker, it's usually on an official looking sticker that is sealing the box.


I haven't looked at the pic but street date being in sharpie could be legitimate. Two possibilities are item gets shipped to a store before a given session street date is set and an email goes out to the managers telling them to label the date on it when it shows up.
Second possibility is it comes in with a label on one side of the box and a manager duplicates the information on the other sides because they know that if they don't someone will open it up and claim that they didn't see the label.
Both things happen frequently in retail.

I actually wonder if we could start a class action lawsuit for taking our email address with the promise of information on the Galaxy Nexus and then only spamming us with RAZR information. At the very least it's unethical.

If this is truly about marketing and so on, what harm would come from allowing the Phanatical (purposefully misspelled) to get their hands on it as a soft launch before they "do their thing?"

We're not going to cave and buy Razrs or anything else, so just pull the trigger for the crazies and then do your marketing and such.

The masses wouldn't even know they missed the "real" launch.

Sigh. Looks like the 15th is the next target date. Which means I won't be able to pick it up until after I get back to the US after Christmas :(

But that's ok. I can live with my current phone for the next 3 weeks. What really upsets me is the lengths Verizon's going through simply to shaft us. Staying silent is one thing, but forcing corporate stores and 3rd party retailers alike to LIE ABOUT STOCK is beyond unacceptable. It's despicable behavior, and I don't even see what Verizon has to gain from this whole debacle.

So anyways, back from my little lunch trip. I stopped by my Verizon store, and while I was waiting for a rep, I checked out the Rezound. Not bad, the screen looked beautiful of course. Then the rep came by, I told him I was interested in the Galaxy Nexus. No deer between the headlight looks, no clamming up, just sorry, it was supposed to release today, but got pushed back. I asked to take a look, and he said let me check in the back for one, and came back out. Man is it a sexy phone. The Rezound has nothing on it IMO from a feel standpoint, and the screen is gorgeous. and its so thin. Anyways, he said he didn't know a date, so I told him the forum I am on is thinking the 15th, and he smiled and nodded and said yeah I can't give out dates yet, but you should probably plan on stopping by on whatever day you think it is... haha.

And of course, I get back and see I missed a ton of news and excitement, and then dismay. Sorry OTD and Cincy! So close.

I know what you're implying and this forum is not the place for that discussion. If you have a problem with what you think he might have possibly meant then report it. Otherwise drop it.

I'm not sure what I could have implied. I asked him quite frankly, does he have any other reasoning why he singled out Africa? He could've simply answered the question.

If you know what is implied, maybe you should've shared these implications instead of keeping them secret.

Uh, yeah they can.

I know they can as it stands. But if they have sales agreements/contracts with such dictates for full retail sales of devices they don't want sold I think there is a good chance parts of such agreements go against the open network rules on the C-block spectrum they don't really OWN so much as the FCC lets them use it. Such clauses in sales agreements would be able to exclude the sale of open devices they are supposed to be allowing on the C-Block.

In the end they probably aren't breaking any law or rule related to their spectrum use technically, but they are DEFINITELY being unethical in how they are following/complying to the intent of those rules. Even their open device web portal is all a big sham. The only somewhat standard consumer smartphone listed there was supposed to be available end of last year and still can be found anywhere. The small company developing it might have their own problems, but I am betting a lot of the issue is VZW giving them the run around about actually getting it approved for sale with whatever cert it needs.

I wish people would stop comparing the GSM release to the CDMA LTE release complaining about how other countries got it before us.

You want a GSM version then go buy yourself one.. Oh whats that you say there is a difference? Point made.

If only you knew the wonders of technology we Americans miss out on a daily basis that end up being common place in Asia before we get wind of them.

Sorry just as flustered about this as anyone else, right now all we have to blame are business politics.

Can we please do something together as a group? We are not representing Android Forums, but consumers who are displeased about Verizon handling the phone. Can we all band together and send 'tactful' emails to not only Verizon, but Google and Samsung, too? Put pressure on all three sides. This is ridiculous.

For some of you to be able to take the phone out of the store and have to bring it back, to activating it in the store, to some saying, "We don't know when this will be coming out," has got me livid. Now I know I've been saying, "Verizon has never officially released anything," but the fact that the phones are sitting in the stores ready to go with no pending hardware/ software issues, there is NO reason for Verizon to be doing this. We were THAT close to seeing it today, and all of a sudden, WHAM, delayed.

If I could, I'd piss in a cup and send it to the CEO of the company. This has got to be the worst phone release in the history of Android.

Yea, I had planned to return the Rezound today no matter what. I didn't want to get too attached to it. So when I went in this morning to Best Buy I explained that I wanted to return the phone and see about the Nexus. The manager came over and pulled out a box that literally had my name written on it in Sharpie. He pulled out the phone and let me look at it. Then he started asking me for information. I asked if he was allowed to sell it and he said, "I don't really care either way." I made it quite clear that I wasn't looking to get anyone in trouble over a phone and he replied, "There is no chance that I could get fired over something like this, so let's do it." Right after that, I posted.

The funny thing about all this tragedy is that he actually had to call Verizon because my account wasn't completely reset from the Rezound return. He gave them all the info for my account as well as every bit of information on the box of the phone and the Verizon people didn't say a word about it.

After the phone was activated and I started playing around with it he went to ring me up and that is when we hit the snag. The one thing that put a stop to everything was the phone not being in their system. Since it wasn't there they couldn't go any further. I had to give the phone back and they reset it and reactivated my Fascinate.

I will say this though, if nothing else this has made me realize how much I really want this phone. Maybe it is because this one was actually supposed to be mine, but I swear it was twice as beautiful as the demo I had handled earlier. I will have my Nexus!

Unfortunately, there are no damages (in the legal sense), thus, no viable lawsuit. While we may be emotionally damaged, it does not rise to the levels that would support any claim.
