Charged for MMS after using the emote key in messages

Hi all , Has anyone else come across this problem .
I am in the UK and on T-Mobile , just received the Note 3 for my wife

Problem is that she likes to text message and to use emotes ie smiley face etc .
She was using the built in emote key which is built into the key pad in messages ( Sym - this then bring up a smiley icon - tap this and you get all the built in emoticons ) BUT ... and here is the problem .. when you use one of these emotes in your message the message is changed from a SMS to a MMS ( so she gets charged for a picture message ) even if the message is only a few words with the emote

This doesn't seem right or fair seeing as it is a built in key not a add on or an app .

Anyone else had or having this problem / or maybe not noticed ?

Just happened to me :-(. My partner was texting me and an emote came through (partner uses an iPhone). Not sure what the emote was on my partners phone but it came through as the equivalent emote on my phone, so I sent one back, no text. Unfortunately as I hit send as soon as I selected it, I didn't see it say it was converting to MMS and just got a message saying it'd be sent as soon as mobile data was active :-(. Just took a look after seeing Simons message and see there is a little message that pops up at the bottom saying it's being converted and one you delete the emote, message pops up saying it's converting to SMS.

Currently wondering if I'll get charged if I don't turn data on and delete the message. Also on T-Mobile UK.

you're right. emoticons inserted in text messages converts it to MMS. i am in the Philippines, i'm using a NOTE 3 with SMART as my network.

It is not the emoticons which are the problem, emoticons are just made up from a group of text characters. It is the new coloured emoji's which are now classed as pictures causing the conversion.

I am quite disgusted that a simple smiley could cause a 30p charge.

I read somewhere that the new hangouts app causes this to happen due to its new sms function.

I wouldn't care if my mms come out of my sms quota but they don't!
