auto comp ins, and dead falling trees

    had a 50 ft oak tree take out the bed of my pickup last fri in my driveway...
    the tree was pretty rotten...
    ins adj is calling me tomm...
    is it gonna matter if the tree was dead as far as them covering my damages??

    I've had this happen. It basically boiled down to the fact that if the tree was obviously dead, then it's a condition that you should have dealt with before the tree came down, and thus there's no coverage, because it was preventable. If a healthy tree had come down in a storm, it would have been covered.

    More than likely unfortunately they will use the tree being dead against you so that they wont have to pay out.
