So, i am available for an annual upgrade on november 9 after. I looked online to make sure i would be able to get the DX on the 15th when it came out. it didn't look like i was able to get a smartphone for the 2 year contract price. so, i called customer service and they said that i am indeed able to upgrade on nov 9 but i'm not eligible for the early upgrade because i am currently a smartphone user. has anyone else heard this? if this is true i'm extremely pissed.

I think there is a difference between early upgrade for non-smartphone users VS early upgrade for anyone getting Droid X.

If you are eligible to upgrade in Nov, doesn't that mean that your contract is actually up in 2011 (you can typically upgrade 4 months prior to the end of the contract)? When did you get your last phone/renew your contract?

my last phone was a DROID the day it came out. So like November 9 2009 i guess.

I saw like a terms and conditions page linked here somewhere that i thought said all people eligible for upgrades, and i know it listed annual upgrades, would be eligible but idk where i saw that at. all i know is that after hearing about this early upgrade and how stoked i have gotten myself for a droid X, i am going to be seriously dissapointed if i cannot upgrade until november!

I am in the same situation as you. I have owned the Droid since release day and was expecting to get the Droid X on the 15th. I am going to go into my local corporate VZW store later and see what they say.

If you got a 2-year contract, it will be up in Nov 2011 and you can't get the early upgrade (it is based on contract end date, not phone upgrade date). Supposedly, if you have a high-priced plan, you can get annual phone upgrades on a 2-year contract.

I am not 100% sure on how it works for single line plans as its been a while since I have had one but I know that on a family share plan the main line is eligible for an early upgrade every year even on a 2 year contract.

yes, that is how it has always worked. and, she did confirm that i AM eligible for an annual upgrade on november 9, 2010. but she said i wasn't eligible for the early upgrade for anyone in 2010 because i am currently a smartphone user and its only for people who will be newly upgrading to a smartphone.

Not on mine it isn't. However, that is irrelevant. Again, the early upgrade offer is based on contract end date, not phone upgrade date.

When was this confirmed? Last I read the VZW handout specified contract end date and upgrade date in 2010 were eligible.

For all you guys that have contracts ending in 2011 i'm on the same boat as you. But i've been thinking since i have 2 lines which include my girlfriend and I and she really doesnt care about her phone i'm thinking of cancelling her line (early termination fee $140.00) and then giving her my number and phone and just adding the droid X as another line for the promotional price of 199.99 for myself. I mean, you do the math, in the end you're still saving money as opposed paying full retail for the very much anticipated Droid X. Regardless you'll be signing into another 2 year contract if your adding the line or upgrading at the promotional price. This is just a small heads up for those of you that havent really thought about the early termination fee. And if you have only 1 line, early termination will be up to $250. With 2 lines, usually the non-primary line is the cheaper one for the early termination fee.

Couldnt you just add a line for 9.99 and pay the 2 yr price for the Droid X? Then put some non smart phone in place of your orginally Droid? Or just upgrade her line with Droid X, then put her phone on your main line so you dont have to pay the $30 data fee?

that is my plan actually, to add a line for 9.99 which will be the droid x for the 199.99 2 year contract. At the moment i have two bb tours and dont have any other cheaper phone laying around to give to her, So i'd have to just cancel her line and then re-add a line which will be the droid x. Let me know if thats what you meant, i'm still a little confused as to what you meant by what you said, enlighten me please.

btw hers and mine are already in a "family plan" with hers being the one i added for 9.99 a year ago

I currently have a smart phone and upgrade is due in aug and they told me I am able to upgrade right away. I think the person you talked to didnt understand you or know what they were talking about.

maybe your contract ends after 2010 thats why you are unable to upgrade right away? If your contract ends(not when u can upgrade) after dec you are not elegible

Well I called VZW last Thursday and the woman I spoke to said I could upgrade to the DX from my Droid before my annual upgrade Dec 28th. A few days later I stopped into the corporate store and they said I would not be eligible to upgrade early because I already have a smartphone. I don't know who to believe at this point. I'm just gonna try to get it anyway and see what happens.

This is going to be interesting. Generally I tend to think the phone reps have a much better idea of what is going on than the store reps. Phone reps get information faster, and are actually assessed based on accurate information. That being said, I don't see what is in it for Verizon to allow 1 year upgrades early.

If you aren't even eligible for an annual upgrade yet you aren't going to get an upgrade offer. You will never get your annual upgrade early. One year is the absolute earliest you're going to get anything.

This early upgrade deal is ONLY for people whose CONTRACTS end in 2010. Not if your upgrade date is in 2010. Basically it only benefits people whose upgrade dates are from now until August 31st (regular 20 month upgrade, not annual upgrade). After August 31st if you're contract is up in 2010 then you'll be eligible anyway because you can upgrade at 20 months which is 4 months before your contract is up. It sounds like a huge special offering but only affects people who are eligible during the next couple months.

That makes pefect sense to me. It seems though that many folks who upgraded to the Droid at launch in Nov have called, and been told they could take advantage of the early upgrade in July. Again, I dont see why Verizon would do this, but I also don't think all these folks are making it up. Cant wait to see Verizon's official statement about it.

I can give you an official answer. This is a document from Verizon I have as a store owner:
This promotion is available from June 23, 2010 to August 31, 2010 and requires a new 2-year customer agreement.

Each eligible Mobile Telephone Number (MTN) can upgrade only once during the promotional period
␣ Upon taking advantage of the promotion, the MTN will not be eligible to upgrade that line again for 12 months; which must be disclosed to the customer
␣ This promotion cannot be combined with any other offer/promotions (including Bill Incentive Credits)
␣ Requires data package $29.99 or higher ␣ Contract end dates will be extended 24 months. ␣ Device eligibility dates and NE2 will be extended 20
    months

Any customer with a service contract end date of 12/31/10 or earlier, including:
    o Consumer o Employee Liable (ELEU) o Corporate Non-Contracted
o Corporate Liable (CLEU) up to 99 lines (at the ECPD level) ␣ Includes SMB profiles only ␣ Excludes Fed Govt and Local/State Govt and
    National Profiles
␣ Not currently NE2 (New Every Two), EUP (Equipment Upgrade), AUP (Annual Upgrade) eligible
    ␣ Account must be current
␣ Promotion cannot be used for a "Buddy Upgrade." The eligible line must upgrade and keep the 3G Smartphone
