Insurance PLan Question

I currently am using a Fascinate as my main phone. I upgraded to this phone because I was not able to get a tethering plan for my Droid 1. My Droid 1 has 2.2 (Froyo) but is flakey when it comes to data, here is my question......
If I switch my phone on vzw back to the Droid 1, can I make a claim with Asurion for the data hiccups or am I stuck with the Fascinate?

So my plan would be to switch to Droid 1, go online and make a claim, use the phone they send me...likely a Droid 2 or X with 2.2 (Froyo) since they no longer are replacing the Droid 1 with Droid 1's.

Thoughts??
