Help Desire Key Fuctions Mixed Up

SAVE ME.

I just recently purchased a second hand HTC Desire to tie me over until i renew my contract at the end of the year.
Problems arise.

1. The back button works the same as the home button. ie takes me to the home screen EVERYTIME. i cant just skip back a menu/screen. Insanely annoying
2. The menu button works like the search button. So i cant get to the options/setting and all that. I get a glance that the menu has come up which is the quickly overridden by the search screen and keyboard... at which point i hit the back button... and im at the home screen.... again.

I dont know if its been rooted or not.
I've restored factory settings. (x3)
I've tried google but came to dead ends.

Any help us mucho appreciated.

In your App drawer, do you have the Super user app?
That will tell you if you are rooted, seems very weird though.
When you did a factory reset, did you do it via settings or by turning the phone on then holding the down button? Tbh i dont know if there is a difference, but i always get advised by Orange to hold volume down to do a factory reset.

Does it do it fresh after the wipe or when you install anything?
If you do hold volume down, does it say S-On or S-off.

or, could literately be a faulty phone.

Nope. No Super User app. I downloaded it but I don't know what to look for, that will tell me it's rooted?

I did only reset via the settings. After your suggestion I tried to do it manually and discovered the volume button doesnt work.(the volume bar appears when pressed but it doesnt DO anything) What a joke.

After the wipe nothing changes.
Tried holding down the volume button.. but nothing. (faulty button)

I think im definitely gonna try to get my money back. He said it was working 'perfectly'.
