Stolen phone video in San Pedro, CA store

was that really theft?

someone lost their phone...
someone found a phone...
no one stole a phone

IANAL but I'm thinking they removed an item from the store, without notifying any staff or paying for it. Doesn't matter if it's lost property, merchandise or fittings, that's theft.

If they found it in the street, that's a different matter. Although the good thing to do would be to hand it in at a police station.

I was on jury service once, and one of the trials was, two people removed an apparently abandoned item from a piece of land. It was recorded on CCTV. It was an old outdoor light fitting that was just lying there, and the land belonged to a railway station, i.e. private property. They were found guilty of theft and fined.
