I have had mine since launch. I called HTC yesterday and they said I could swap it or have it repaired. I am going to swap it for a new one. The only draw back is that they will charge my debit card for the full amount until they receive the old one back.
They don't charge anything. It's just an authorization so that they CAN charge something if they have to.
My N1 has been used in the office, in the house, and in the car. None of these are dust ridden areas. I keep the phone in the provided pouch while in my pocket.
I think there is an issue with the seal around the glass. At first I noticed very fine particles under one corner. It wasn't noticeable unless you looked for it in direct light. However, just the other day, I large spec of dust appeared right in the middle of the screen. It is very distracting.
why no jusy get rid of the thing.........its a coold device sure ut its also 577 dollars... is this worth it.......

im thinking the same thing. We spend so much money on these things yet there's always one little thing holding it back.
Im now considering not getting this, when just a few weeks back i was 100% certain of getting it. This is very disappointing.
if its anything like my iphone 3gs when i had this issue after about 2 mts i sent it in and all they did was clean it... and thats apple! im sure google will do the same... just clean it until it happens again..... yup 577 bucks is worth being without a device for a routine cleaning every few weeks.........I have one single tiny piece of dust to the bottom right hand corner. It's only visible in direct sunlight, I see it for maybe 1% of the time I use my phone (although that doesn't mean that more won't appear in the future). HTC have told me they will replace/repair under warranty.
I really recommend getting it repaired, even though you'll be without your phone. If you get a replacement, you'll likely just get another phone with the same problem instead of getting a repaired phone where the problem won't occur again.
They'll likely give everything else a once over too, just to check it's good to go. There's no way I'd get a replacement for this fault. But I won't be sending it in til it's actually noticeable without holding the screen 2mm from my face.
