need advice with getting warranty replacement

So...
I've been having a problem for months with my headphone jack. Sometimes the sound is staticy. The sound will constantly switch from working in both ears, then to 1 ear, then to both, then to none..then back again. (very annoying if I'm listening to Pandora with the phone in my pocket while mowing the lawn..because it pauses the song...now I have to take my gloves off to turn the song back on..)
And I've used at least 4 different sets of headphones to replicate the problem.....

I called yesterday and they over-nighted me a replacement phone. It's a reconditioned Droid 1...its in beautiful condition...except........
The power button feels like it's been mashed in. It works...there's just no "click" to it. I'm not happy with that.

I bought the phone on launch day, so I'm almost at the end of my 1 year warranty (I think it ends Nov 6th).

I'm thinking of calling up to have them send me another. What are my chances of getting them to send me a new phone? Best case scenario would obviously be that they send me a new phone, even better if it's a Droid 2, and even better if it's a Droid X, since I don't even use the physical keyboard anymore.

Any advice on what's the best course of action?

If it were me I would call and complain about the power button. I talked to Verizon yesterday and tried to get an upgrade but they said since they have Droid 1 in stock that is what I would get. Guess I didn't push too hard but if the replacement phone that I am to receive is flawed I will call and push for an upgrade. It would have to be a Droid 2 since I have the car and multimedia dock.

The replacement phone comes with a 90 day warranty from what Verizon told me yesterday.

If they have droid 1 in stock that is what you will get. Unless you go balls deep and speak to multiple managers and they give in to you just to get you off the phone ,then you may get a different phone,

i have the same problem with my headphone jack. im on my second phone right now and i still have the issue, i really want the droid x, i wish they would let me have even a refurb for 300 , i would be happy with it, but they keep giving you the same phone with the same problem, just today two or three times the jack would go static and then the music would turn on party mode and play some random song, has anyone ran into that issue? im gonna go to the store tomorrow and see if i can try and knock some sense into them, its like supervisors at work, your having a problem, but since they dont experience the same thing, they think nothing is wrong, but if they just worked in your shoes for a day, they would see the big picture. thats vzw, they know there is a issue with the jack, but just deal with the problem by giving you another phone, how about a different phone that isnt having the same problem, i havent ran into anyone with an issue on the x or 2 for that matter.
