busted speaker?

You have 2 possible scenarios as far as returning the phone goes.

If you ar within the 30 days then you can take it back to the store and get a new one.

If you are outside the 30 days then you can call them and have a replacement sent to you via FedEx and return postage for your broken phone.

In the 1st scenario you run the risk of them looking at the phone and seeing that you have the leaked 2.1 on it. Whether they would say that you lost your warranty due to that or not I can't answer.

In the 2nd scenario you just send the phone back via the FedEx box they sent you. I cannot answer whether or not they look closely at it when you go this route.

I would assume that in either scenario they would notice when they try to refurb your phone and perform a factory reset only to notice it looks different. Since VZW contracts a 3rd party to do refurbs I don't know if that 3rd party would inform VZW about it or not.

I DOUBT that they are really paying that kind of attention, but of course couldn't say for sure. However you do have another option if you want to make sure and stay under the radar 'just in case'. Wait until the OTA of 2.1 before you call for service, then your phone will look like all the others.

Playing devil's advocate here. Depending on how long he has had his phone, it may be out of the 1 year mfg warranty before OTA 2.1 comes out.
